Finally, some good news regarding our efforts for H-2B cap relief. The Department of Homeland Security (DHS) has issued a supplemental H-2B visa rule releasing 64,716 additional visas in three tranches.
There is no Northern Central America (NCA) carve-out in this release.
Visa availability is based on the start date of employment:
- Jan. 1 – March 31:18,490 visas (returning workers only)
- April 1 – April 30: 27,736 visas (returning workers only)
- May 1 – Sept. 30: 18,490 visas (new or returning workers)
The attestation form will be required to demonstrate the business-need standard (irreparable harm). Additional details will follow from your FEWA Guide regarding your specific H-2B filing.
